DMCA Policy
Last updated: February 2026
Nudify Tool AI (“we,” “us,” or “our”) is committed to respecting the intellectual property rights of others and to complying with the provisions of the Digital Millennium Copyright Act of 1998 (“DMCA”), 17 U.S.C. § 512, and other applicable copyright laws. This DMCA Policy describes how we handle claims of copyright infringement and how you may submit a takedown notice or a counter-notification.
1. Our Commitment to Intellectual Property Rights
We take claims of copyright infringement seriously. We do not permit users to upload, generate, or distribute content that infringes the copyrights, trademarks, or other intellectual property rights of third parties. Our platform is designed for the creation of original, AI-generated content. We respond to valid DMCA takedown notices promptly and maintain a policy that may result in the termination of repeat infringers in appropriate circumstances.
2. Designated Agent for DMCA Notices
All DMCA takedown notices and counter-notifications must be sent to our Designated Agent:
Email: [email protected]
Please use the subject line “DMCA Takedown Notice” or “DMCA Counter-Notification” so that your message can be routed correctly. Notices sent to other addresses may experience delays.
3. How to File a DMCA Takedown Notice
If you believe that content on or accessible through Nudify Tool AI infringes your copyright, you may submit a written DMCA takedown notice to our Designated Agent. Under the DMCA, your notice must include the following elements to be valid:
3.1 Identification of the Copyrighted Work
You must identify the copyrighted work that you claim has been infringed. If multiple works are involved, you may provide a representative list of such works.
3.2 Identification of the Infringing Material
You must provide information reasonably sufficient to permit us to locate the allegedly infringing material. This should include the specific URL(s), page(s), or other identifying information (e.g., description of the content, date, or user identifier if applicable) so that we can find and remove or disable access to the material.
3.3 Your Contact Information
You must provide your full name, mailing address, telephone number, and email address so that we can contact you regarding your notice.
3.4 Good Faith Statement
You must include a statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
3.5 Accuracy Statement
You must include a statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
3.6 Physical or Electronic Signature
You must sign the notice physically or electronically (e.g., by typing your full legal name).
Submitting a false or misleading DMCA notice may result in liability for damages, including costs and attorneys’ fees. Before sending a notice, please ensure that you have a genuine belief that the use infringes your copyright and that you are the owner or authorized to act for the owner.
4. Our Response to Takedown Notices
We aim to respond to valid, complete DMCA takedown notices within 24 to 48 hours. Upon receipt of a notice that substantially complies with the DMCA requirements set out above, we will:
- Remove or disable access to the allegedly infringing material;
- Notify the user or account holder who provided the content (if applicable) and provide a copy of the notice; and
- In appropriate cases, take steps to prevent repeat infringement, which may include termination of access or account.
We may request additional information from you if your notice is incomplete or unclear. Delays in providing such information may delay our response.
5. Counter-Notification Procedure
If you believe that content you submitted was removed or disabled as a result of mistake or misidentification, you may send a counter-notification to our Designated Agent. Your counter-notification must include:
- Identification of the material that was removed or disabled and the location (e.g., URL) where it appeared before removal or disabling;
- A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification;
- Your name, address, telephone number, and email address;
- A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who provided the DMCA notice or an agent of such person; and
- Your physical or electronic signature.
Upon receipt of a valid counter-notification, we may forward it to the party who submitted the original takedown notice. If that party does not file a court action seeking a court order against you within a period required by the DMCA, we may restore the removed material or re-enable access at our discretion and in accordance with the law.
6. Repeat Infringer Policy
In appropriate circumstances, Nudify Tool AI will terminate the access or accounts of users who are repeat infringers. We may also remove content and/or terminate access for a single serious infringement. Our determination of repeat infringement may be based on the number of valid DMCA notices received, the nature of the infringement, and other factors we deem relevant.
7. No Waiver
Nothing in this DMCA Policy constitutes a waiver of any of our rights, including our right to seek any legal or equitable remedies, or to assert any defense, including fair use or other limitations on exclusive rights under copyright law.
8. Changes to This Policy
We may update this DMCA Policy from time to time. The “Last updated” date at the top of this page will reflect the most recent revision. Your continued use of Nudify Tool AI after changes constitutes acceptance of the updated policy.
